Medical Negligence case

Adam Horner recently acted for a client who had suffered alleged medical negligence. Mrs H reported frequent and recurrent dizzy spells for over a year. A diagnosis of vasovagal syncope was made.  A Loop Recorder was implanted before undergoing further investigations such as a tilt test and repeat ECG monitoring.

The Solicitors for the NHS denied liability on the basis that the Loop Recorder was attempting to find a diagnosis however Adam was able to show that further tests could have found the correct diagnosis and that by proceeding prematurely to the implantation of the loop recorder and thereafter removal was stress, pain and suffering that could have been avoided.

Adam managed to obtain an out of court settlement for Mrs H which she was delighted with.
